When searching for an apartment in Poland, you may encounter a landlord's requirement: "we need najem okazjonalny". What is it, why is it needed and how to arrange it — we explain.
What is Najem Okazjonalny?
Najem okazjonalny (occasional tenancy) is a special type of rental agreement provided by Polish law. Its main difference from a standard contract: in case of a breach of rental conditions, eviction happens significantly faster and more easily.
To conclude such an agreement, the tenant must provide:
- A notarial declaration of willingness to vacate voluntarily
- An address where the tenant will move to in case of eviction
- Consent of the owner of that address (notarially certified)
Why landlords want it
Under standard Polish law, evicting a non-compliant tenant is a lengthy court process, sometimes taking years. Najem okazjonalny gives the landlord a faster and legally cleaner resolution tool. That's why many owners — especially those with expensive apartments — specifically require it.
